Acceptable vs. protected

You seem to have run these two different concepts together. I didn't say it was in good taste to associate Doug Mah with Rush Limbaugh (although I find it pretty funny), I said it isn't going to be taken down. All political satire is protected speech.

Obviously, if something is obscene or racist, it is no longer protected.

If Doug so chooses, and I may help him, he can file a complaint with WIPO and easily win a claim against the unidentified respondant (who at this point is hiding their registration information - wonder why?).  Very telling...

First, the domain name, dougmah.com, is not easily confused with other names (e.g., unlike a scenario where someone with the last name McDonald could supercede the company).  Secondly, the person who registered the name did so in bad faith.  It was not registered for any meaningful contribution.  Third, they have no right or legitimate interest in the domain name.  Fourth, the redirection of the domain name supports the bad faith registration claim and itself continues down the bad faith path.

C'mon, you're reaching here.  The call that this is satire and protected is laughable.  It's purely pasquinading.  How can you support such juvenile behavior?  Do you not value honesty?

By my reckoning, there are many uses of the internet (including domain registration) which fall within political satire (including the Yes Men, The White House, etc). I haven't heard of them being sued for bad faith.

Domain Name Lawsuits

Happen frequently.  Microsoft was involved in one with www.mikerowesoft.com.  We settled and admittedly were too serious in how we handled it.  Jenna Jameson filed a suit with the WIPO and lost.  Lots of past suits involving likeness and commercial profit are out there.  Some won, some lost.

Of course, I'm disappointed.

I count on OlyBlog for a certain level of dialogue (mature, playing the ball, forwarding the discussion), and this is definitely not that. One of the things that really inspires me about running for office is the opportunity to counter some of the cynicism and resignation around electoral politics. This post will have the opposite effect. I agree with Rick that it's protected speech, and I don't believe that the docents ought to remove the post. I do, however, encourage Real Olympian Hero to voluntarily remove his or her post. It doesn't help my campaign, and it certainly doesn't improve the quality of our dialogue here. I also encourage you to research and discuss Doug's public record as it relates to things that are important to you. I assure you, there is probably enough there to achieve what it is Real Olympian Hero is trying to achieve. When Doug finally gets his real website up and running, I hope someone posts a link here. Now that would REALLY help my campaign.

Returning the Domain Name

I'm asking Real Olympian Hero, publically, to return the registered domain name dougmah.com to Mr. Mah.  I believe I've done enough research and have a valid case to pursue a claim against the registrant (unknown) and registrar (GoDaddy.com).  In reviewing the potential for litigation, it occurred to me that we could simply ask for the name back.  There is enough case law out there through WIPO, ACPA, and other legal entities to make a legal case.  But why?

While someone might try to claim this was an attempt at political speech, that should be pretty easy to defeat because there's no actual political speech going on here.  There are cases saying pure redirects without any attempt at commercial exploitation or political speech are invalid and the name should be turned over. The whole "Doug Mah for Olympia Mayor" on the application title bar supports this. This is purely cybersquatting.  So, can we play nice?

First of all, cybersquatting refers to sitting on a domain name with the intention of selling it to someone who is likely to want it. That is clearly not what is happening here. Indeed, 90% of what you reference depends on trademark infringement, which in turn, depends on commercial exploitation. As I noted previously, there is no profit motive in play with this situation. Thus, you have to prove that the domain name is being used in "bad faith." But if there is a political message that is being communicated, that would be a protected use. Now, you may think that there is no expression of a political message by associating www.dougmah.com with Rush Limbaugh, but I certainly do, and I think that many others do to. Thus, it is satire, with a political message as well. Please point to the specific case law that deals with a comparable situation.

I'll address your first of all, first.  No, cybersquatting is not dependent upon the sale of a domain name.  Check the ACPA from 1999, sign by your favorite, Bill Clinton.

I'm certainly not going to do the homework for you.  Instead, I'd rather the domain name owner step forward and act accordingly.  If you want a head start, search for "domain names" + "personal names" in your search engine of choice.

Rick believes it to be satire, so it must be so.

Look at the application title bar, Rick.  It reads, "Doug Mah for Mayor" yet there is nothing related to Doug Mah in the context of Rush Limbaugh's site.

I'm willing to continue the pursuit of this domain name for Doug because I believe it to be registered in bad faith and the right thing to do.  In all honesty, I'd do the same for Meta, or Craig, or anyone else running for council.  It's such a juvenile effort to put Doug in a bad light.  Rather than tear down Meta's competition, why not spend your time and energy building her up?  Typical politics, I guess.  I was hoping I could count on Olyblog to join me in making a difference, but it seems I may have been wrong.

We are so fortunate to live in a country where industries that serve the public are subject to public regulation, and where ordinary citizens have this kind of recourse. I support your efforts in this matter as I have supported other citizens pursuing legal recourse within regulated industries. To be politically correct

 There is a post today, in the LTE thread that talks about this issue.  I'll hope that the poster will put the same message out on Olyblog.

I've said from the beginning that I don't vote for Mayor of Olympia, thus I have no ax to grind, but I don't like to see any political campaign become fodder for silly insults - call it "satire" or not - and I love satire.

Meanwhile, I hope Olyblog can remain a true honest place of information and not become partisan for any reason.

Not likely in my personal opinion. There are a handful of words that pop into my head when I think of Meta. Sneaky, mean, under-handed or unfair are not any of those words. She may know who has done it, but I don't think that it was her idea, or something that was supported by her.

I have to agree with everyone else, EG. Meta is one of the most guileless people that I know. She's personally gotten on my case about some of the anti Mah stuff that I've done. I agree with her that it only hurts her campaign for people to be negative, and I won't be in the future. I think somebody played a joke with the website and you should relax about it. It's not squatting, it's not illegal, it's just a joke.

Obviously you didn't get a chance to see the updated site.  On the updated site, someone created a page that looked like a sanctioned campaign page (complete with Doug's picture, address, phone number, and e-mail), but it was clearly taking shots.

I saw it, it was still satire. The writing was very matter of fact about things Mah has done while in office, such as supporting the conference center, and the Miller water treatment deal. The writing wasn't negative at all, it just highlighted negative parts of Mah's public life.

I just wonder if you think Jon Stewart and Stephen Colbert are losers too? They engage in satire about politicians all the time, and are a lot worse on them than this site was to Mah.

Your assertion that this was satirical is where I believe you are wrong.  GoDaddy agrees, otherwise the site would still be up.  GoDaddy's terms of use are black and white.  After reading them, it was clear the terms were being violated.  More than one person contacted GoDaddy about the site.

You may call it what you'd like Rob, but you and I both know that passion isn't obsession.  You, of all people, should understand.  I'm disappointed you can't wrap your head around feeling strongly about a subject or idea.

Btw, I enjoy Stewart and Colbert.  I don't place them in the same category as the person who proxy registered the site.  You might, I don't.  And on that note, I'll agree to disagree.  I've had my fill of arguing about the subject - we'll let the chips fall where they fall.

I have some personal feelings about our Internet that I'll share in detail when I have more time.  As it is today, the Internet is a circus.  It can't be relied upon for emergency, it's infrastructure isn't being updated to support its use and the need to control the Internet (mainly by telecoms and corporations) is driving a wedge between its current state and progress.  There's more, but I'm not prepared to spell it all out right now.  We need better standards and we need more people to take the Internet seriously.

We drag each other through the mud all the time, doesn't make it right, but you shouldn't be all that surprised. I'm with you on this one, EG.  The site was inappropriate.

I'm not sure it initially had anything to do with the race though.  It went up before the race began, last winter.  It was probably some butthead with computer skills who was pissed about the sidewalk ordinance.  I'm glad it has been taken down.

There were updates recently that you must have missed. The site was redesigned like a Mah campaign page and had sort of a list of events from Mah's political career, such as the shady brewery water deal, and the conference center. I think it was satire, and I understand that you think differently, you have your reasons. In the end, I think it's funny. And yes, I would think it was funny if someone did it to me. If it was the same format with the same passive writing style it wouldn't even come close to touching the great things that have been said about me on the Olympian comments. It was a really respectful list of reasons not to vote for Mah, it just didn't come out and say it, maybe if it had, we wouldn't be having this conversation.
