Also if there wasn't regulation on RF emissions, you might not be able to receive anything due to interference.

Therefore it is not in the interest of any broadcaster licensed or unlicensed to create interference. The anecdotal "technical" data the FCC cites to back up that position dates to the situation before the communications act of 1934. radio technology has evolved alot since then. it is a matter of course for any responsible broadcaster to emit a clean signal. we don't need big brother to tell us when and how we can vibrate the molecules of the atmosphere. we are electromagnetic beings, after all.
there have always been radio pirates, there will always be radio pirates. criminalizing a behavior just makes more criminals.
