Tumwater School District administrators must take a hard look at racism in their schools.

In a recent incident, a white Black Hills High School student flew a Confederate flag from his truck on campus, prompting a verbal dispute with at least three black students.

I, Emmett O'Connell, self-proclaimed Defender of the Constitution and Protector of Free speech, Knight of Jefferson, here by declare that being a sixteen year old and flying the flag of the Confederate States of America is not necessarily an exercise of free speech.

I'm referring specifically to the "clear and present danger" test of a limit to the exercise of free speech. As Justice Oliver Wendell Holmes put it, you can't yell fire in a crowded movie house. Similarly, you don't have the right to yell racial epitaphs in the hall of a high school, and flying the confederate flag from your truck is very close to that.

In this case I don't think the Olympian is advocating limiting free speech, but rather, harmony among students.

The Fire: More than a high schooler in Olympia would know about the North's racial history.

The Fire: We're using this standard to prohibit the display of the Confederate battle flag? I surely hope we don't wander down this path, since I could see it would lead us to be a reflectiion of Europe, where advocating the Holocaust never took place (while absurd) can land you some jail time.

The Fire: And displaying the Confederate battle flag is "very close" to racist? Interesting, and part of the reason I have stated in previous threads that, thanks to Lincoln and the Union winning, they've been able to ensure history would have a favorable reflection on them.

The Fire: I don't think The Olympian was intentionally advocating a limit on free speech but, as a result of wanting "harmony among students," did so.

For sheer curiousity, would you also feel the same way about flying the "Hammer and Sickle?" A number of people with Eastern European backgrounds might not be to thrilled to see that one. Or, as a more relevent example, Che Guevera pictures. Many Cuban immigrants would find such depictions to be as equally offensive as the Confederate battle flag.

True (on the Che shirts and the hammer and sickle flags). There was a recent discussion centered over at SPSCC on the appropriate flag to fly representing Vietnam, whether the current communist regime flag or the Vietnam American Heritage flag. Some symbols are almost innocent to some, terribly meaningful to others.

You guys are missing a big piece, the school had a rule against the Confederate flag, which the school board deemed to be an incendiary symbol. The kid broke the rules, bottom line.

This seems to me like a case of small town folks trying to have big city problems.

I agree with TFI that the "clear and present danger" test doesn't apply in this case.

The Fire: The last time I checked, the Supreme Court ruled an individual doesn't lose their Constitutional rights once they step through the school door, a stance I strongly agree with.

Does the constitution protect

Does the constitution protect a student against a dress code? I don't think it does. Maybe it should. Students aren't allowed to wear shirts with snowmen on them because it's a reference to cocaine dealers. Amazingly, all the kids stopped doing drugs as soon as they stopped wearing the shirts.

Has the constitutionality of school dress codes ever been challenged?
