Thurston County Dep. Prosecutor Soukup was busted for DUI, but maybe we should have seen this coming.

Skelly over at Arbitrary and Capricious has been following this character for awhile. Here are a couple of the good ones:

I must be missing something

 I see a story about someone that was found NOT guilty and another that says he has an "adversarial" relationship with a judge (not uncommon on either the prosecution or defense side, but more often on the defense side). Legal tricks (played on both sides, trust me, I've been the recipient) are often something that annoys judges.

As to the recent DUI, he admitted it, thus I doubt that there will be any question as to a conviction of sorts.

The judge refused to be involved in his cases, which I'm pretty sure is uncommon, or it should be:

 Soukup had filed a declaration accusing the defense attorney of recording interviews with two of the state’s witnesses without their consent, which is illegal in Washington. Soukup based his accusation on information that one of the witnesses relayed to him but he did not verify it independently, court documents say. The defense attorney, Bruce Finlay of Shelton, produced interview transcripts and statements showing the contrary. The judge was asked to rule on the matter.

In January, Hicks sanctioned Soukup, finding that the allegations were false and pursued without a “scintilla of investigation.”

I recall the response of a judge when my ex-wife admitted that her attorney told her to falsify a domestic report, to get a restraining order, in order to take possession of the house and belongings, AFTER she left the premises for a month (not to mention the fraud on the credit card, but I digress).  He was not amused and made note of which attorney told her this little trick.  I'll bet he wasn't welcomed in that judge's courtroom.

Meanwhile the trick accomplished what she wanted.
