Fair use ring a bell? I

Fair use ring a bell? I don't think removing the logo waters down the post at all.
»

Mr. Coleman

As a corporate sponsor of The Olympian, you should know that your company's logo is being used by that newspaper's online edition to spread lies about the City of Olympia. Your interest in this matter is welcome.
»

"....you should know that

"....you should know that your company's logo is being used by that newspaper's online edition to spread lies about the City of Olympia."

A little dramatic no? Couldn't we be accused of doing some of the same here?

"Thurston County residents will be boycotting sponsor Bruce Titus Automotive until The Olympian refrains from lying about the City of Olympia"

Is this the official word for all of thurston county? It sure makes it sound like Thurston county, it's residents, are boycotting Bruce Titus. So if I go there tomorrow, does that make you, and olyblog, responsible for lying about Olympia/Thurston county?

»

uh no..

1) The Olympian is lying about the City of Olympia & Bruce Titus's logo helps to pay for it.

2) You are welcome to patronize Bruce Titus, but I dont think you will, because they are too rich for your blood. You hanging out with us Olyblog scum and all..

If you do go there, make sure to post about your experience, here..

»

Norm..

Are you saying that The Olympian never lies about the City of Olympia, ever?
»

For below

No, I have read stories that I feel were incredibly....exaggerated(sp?) and feel that the story did nothing to help the community or promote understanding. Lying about Oly? Maybe. I don't want to start pinning those labels right now though.

I don't patronize bruce titus or titus will. When I was car shopping both of these businesses had sales-persons that were so pushy/arrogant (and on more than one occasion) that I left once they started being annoying and have yet to return. The volkswagen/kia dealer in the auto mall is the same story. If I happen to walk through the auto mall looking at rigs I pull out my cell phone and pretend to talk on it....or better yet call up an old friend so that I'm actually talking. Amazingly it works.

As for you "scum" yeah, you all make me sick :)  FYI my sister gave me a bike, I'm gonna post some pics soon because I need some help buying some street tires for it. *shudder* Norm may just ride around town on a bicycle.

Eh, if thats the way they

Eh, if thats the way they wanna play honor it and reference this thread where the missing graphic lives. After reading that email I'm not even going to drive by a Bruce Titus Automotive Group©®™ lot.

Yikes, if I were them I would have let that one slide rather than add fuel to the flames.

Car Dealer Substitute: Car lot on 5th & Cherry

FYI. For those potentially car shopping which I happen to be, I have heard nothing but really great things from a number of reliable sources about the car lot on 5th & Cherry. I work right there and they always have great looking cars and they guys have always been real nice and not pushy when inquiring.

If nothing else, I'm pretty sure they wouldn't sick some out of town lawyer on you.

Hmmm....

My take on this is - "I wonder if this attorney in Tacoma reads Olyblog or if an Olympia business might have tipped someone off?".

is logo use fair use?

good talking point & nice wake up
»

Not Black and White

Fair use is difficult to understand given the range of decisions on the topic. Millions of dollars have been lost fighting for and against fair use in court. But, fair use almost never applies to company specific logos or trademarks. It is generally reserved for commentary and a way to allow for inclusion without copyright infringement. The use of the Titus logo without permission is more akin to trademark infringement.
»

yup

The use of the Titus logo without permission is more akin to trademark infringement.

Yeah. This would be a lose-lose situation for OlyBlog. Legally, Titus is in the right here. Logos are usually private property (I can't think of one that isn't), and zealously guarded in attempts to avoid the branded image being associated with negative press.

»

Yeah Enpen is very right

Yeah Enpen is very right about the logo. However somebody there reads this stuff here and in my opinion they didn't make a good impression by going and "tattling" to their lawyers.
»

Someone?

I'd bet my next paycheck that it wasn't someone from Bruce Titus that was monitoring the blog.
